NEMAI STUDIO is a web page that offers decoration services for residential spaces depending on the style and budget of the client. By hiring the services of NEMAI STUDIO, we put at your disposal a qualified team of professionals in interior design who will work to create a design project for a specific space selected by the client and adapted to their budget.

Please read carefully the terms and conditions of NEMAI STUDIO. By clicking the accept button, you agree to comply with these Terms and Conditions and declare that you have the right and the necessary capacity to accept this agreement.

1. PARTIES

1.1 HOLDER

NEMAI STUDIO provides an online interior design service and is responsible for the website and its contracted services.

1.2 CLIENT

By client is understood as any natural person over 18 years of age or legal entity accessing NEMAI STUDIO and completing the steps, including accepting these terms and conditions.

The owner reserves the right to verify that THE CLIENT meets the requirements to hire a prior service. If the requirements are unmet, the total amount paid by THE CLIENT will be refunded.

2. OBJECT

These terms and conditions regulate the contracting by THE CLIENT of any of the services provided by NEMAI STUDIO in exchange for the corresponding economic consideration.

3. ACCEPTANCE

By making the payment, THE CLIENT agrees to be bound by these terms and conditions.

4. SERVICE DESCRIPTION

NEMAI STUDIO provides a 100% online interior design service.

The services are currently provided in the form of design packs, which are described below in points 6, 7, 8, and 9: “Essential Design Pack,” “Functional Design Pack,” “Special Design Pack,” and “Complete House Styling Pack.”

5. HIRING THE SERVICES

The services will be contracted for the space through the website, making payment in full before providing the service. Once the payment is made, the design process begins.

6. ESSENTIAL DESIGN PACK

• SERVICES DESCRIPTION

The Essential design pack (for spaces of max. 35m2) includes:

– Style definition

– Design concept (1 revision)

– Space analysis and personalized survey

– Post-sale assistance (15 days)

• TERM

NEMAI STUDIO undertakes to deliver the project contracted by THE CLIENT in a maximum of fifteen (15) days from the moment when the questionnaire is filled in by THE CLIENT. If THE CLIENT takes longer to respond or give feedback on each design phase, this time variation will be added to the agreed term.

THE CLIENT undertakes to fill out the questionnaire correctly and with sufficient information to his most loyal intent to perform the contracted work.

If THE CLIENT does not approve the initial concept, THE CLIENT is entitled to request one (1) revision, but this will cause the delivery period to be extended in relation to the requested changes.

Once the project is delivered, THE CLIENT has 15 days to make changes. If THE CLIENT does not rate or give feedback on their design, they have up to ninety (90) days to request changes to their design.

• PAYMENTS OF ADD ONS

If THE CLIENT wants to make any changes after this time, it will be charged per hour (45 dollars).

7. FUNCTIONAL DESIGN PACK

• SERVICES DESCRIPTION

The Functional design pack (for spaces of max. 35 m²) includes:

– Style definition

– Design concept (2 revisions)

– Shopping list

– Space analysis and personalized survey

– One (1) call during the process

– Post-sale assistance (20 days)

• TERM

NEMAI STUDIO undertakes to deliver the project contracted by THE CLIENT in a maximum of twenty-one (21) days from the moment when the questionnaire is filled in by THE CLIENT. If THE CLIENT takes longer to respond or give feedback on each design phase, this time variation will be added to the agreed term. THE CLIENT undertakes to fill out the questionnaire correctly and with sufficient information to his most loyal intent to perform the contracted work.

If THE CLIENT does not approve the initial concept, THE CLIENT is entitled to request up to two (2) revisions, but this will cause the delivery period to be extended in relation to the requested changes.

Once the project is delivered, THE CLIENT has 20 days to make changes. If THE CLIENT does not rate or give feedback on their design, they have up to ninety (90) days to request changes to their design.

• PAYMENTS OF ADD ONS

If THE CLIENT wants to make any changes after this time, it will be charged per hour (45 dollars).

8. SPECIAL DESIGN PACK

• SERVICES DESCRIPTION

The Special design pack (for spaces of max. 35m2) includes:

– Style definition

– Design concept (Unlimited revisions)

– Layout

– Shopping list

– 2D Render (1 revision)

– Space analysis and personalized survey

– Constant communication during the design process

– Post-sale assistance (30 days)

• TERM

NEMAI STUDIO undertakes to deliver the project contracted by THE CLIENT in a maximum of ninety (90) days from the moment when the questionnaire is filled in by THE CLIENT. If THE CLIENT takes longer to respond or give feedback on each design phase, this time variation will be added to the agreed term.

THE CLIENT undertakes to fill out the questionnaire correctly and with sufficient information to his most loyal intent to perform the contracted work.

If THE CLIENT does not approve the initial concept, is entitled to request as many changes as wanted until satisfied with the concept, but this will cause the delivery period to be extended in relation to the requested changes.

Once the project is delivered, THE CLIENT has 30 days to make changes. If THE CLIENT does not rate or give feedback on their design, they have up to ninety (90) days to request changes to their design.

• PAYMENTS OF ADD ONS

If THE CLIENT wants to make any changes after this time, it will be charged per hour (45 dollars).

9. FULL HOUSE STYLING PACK

• SERVICES DESCRIPTION

The Full House styling pack (for houses from 90m2) includes the following:

– Full house style definition

– Design concept for each space (1 revision)

– Space analysis and personalized survey

– Shopping list for each space

– Constant communication during the design process

– Full house layout

– 2D Render for each space (1 revision)

– Post-sale assistance (90 days)

• TERM

Depending on the size of the house, NEMAI STUDIO undertakes to deliver the project contracted by THE CLIENT in a maximum of six (6) business weeks (Monday to Friday) from the moment when the questionnaire is filled in by THE CLIENT. If THE CLIENT takes longer to respond or give feedback on each design phase, this time variation will be added to the agreed term.

THE CLIENT undertakes to fill out the questionnaire correctly and with sufficient information to his most loyal intent to perform the contracted work.

If THE CLIENT does not approve the initial concept or 2D Render, THE CLIENT is entitled to request one (1) revision from each space, but this will cause the delivery period to be extended in relation to the requested changes.

Once the project is delivered, THE CLIENT has three (3) months to make changes. If THE CLIENT does not rate or give feedback on their design, they have up to three (3) months to request changes to their design.

• PAYMENTS OF ADD ONS

If THE CLIENT wants to make any changes after this time, it will be charged per hour (45 dollars).

10. OTHER PARTICULARITIES

• OPEN SPACES

When dealing with open spaces, meaning when two (2) areas come together and which differ significantly, i.e., living room and dining room, living room and kitchen, they must be understood as two (2) different spaces if they exceed an area of 35m2, and, therefore, hire them individually. Two (2) spaces will be hired to offer a good service since they are two (2) different areas with different needs.

• ROOM SIZE

The Essential, Functional, and Special design packs are for spaces maximum of 35 m². If your area is larger than this dimension, you must buy another design pack. The minimum dimension we work with for the Full House styling pack is 90 m².

• EXPIRY

Once the package is contracted, THE CLIENT has ninety (90) days to carry out his project. If, at this time, the client does not start the project, the service expires and does not generate the right of reimbursement to THE CLIENT.

If THE CLIENT stops responding during the design process, NEMAI STUDIO will pause the project until further communication by the CLIENT. The restart date of the project will be agreed upon with THE CLIENT depending on the workload that NEMAI STUDIO has at the moment.

11. PAYMENT

Payments can be made either by credit or debit card through the platform or payment gateway made available by NEMAI STUDIO when contracting the service.

The payment gateway is the property and responsibility of the third-party provider. The entire payment process is carried out through a secure connection by SSL protocol.

The payment gateway uses information security techniques generally accepted in the industry, such as firewalls, access control procedures, and cryptographic mechanisms, all in order to prevent unauthorized access to data. To achieve these purposes, THE USER/CLIENT accepts that the provider obtains data for the corresponding authentication of access controls.

12. CANCELLATION

THE CLIENT may revoke from contracting the package for up to 14 calendar days as long as the design process has yet to begin by NEMAI STUDIO. The indicator for the start of the process will be marked by THE CLIENT when sending the response to the initial questionnaire. To withdraw, THE CLIENT must notify the owner, sending an email to nemai.studio@gmail.com

13. OBLIGATIONS AND RESPONSIBILITIES

• OBLIGATIONS OF THE HOLDER

THE HOLDER undertakes to:

Make the greatest efforts to carry out the necessary procedures to provide the services contracted by THE CLIENT.

Comply with any other obligations contained in these conditions or any other applicable conditions.

• OBLIGATIONS OF THE CLIENT

By accepting these conditions, THE CLIENT agrees to:

Pay the corresponding amounts in due time and form, including rates, taxes, and any other costs specified during the contracting process.

Respond for the authenticity and accuracy of any data that has been provided to make the purchase.

Assume the responsibility derived from not meeting the requirements demanded by the Holder to hold the status of the client or from the non-possession of the documentation required for the enjoyment of the services.

 Fulfill any other obligations included in these conditions or any other applicable conditions, and assume any responsibility derived from its non-compliance, leaving the owner totally unscathed.

14. EXCLUSION OF LIABILITY

The HOLDER will, in no case, be responsible for damages caused to the CLIENT for reasons not attributable to it.

The HOLDER will only be responsible for damages caused to the CLIENT as a result of contracting the services through NEMAI STUDIO, which derive from an intentional act.

In exemplary ways. The HOLDER will not be responsible for the following:

1. Of the material or personal damages caused by the furniture assembly, placement, and decorative elements.
2. When the damages and defects in the furniture and decoration items were due to negligent action.
3. Causes of force majeure such as natural disasters, cyberattacks, pandemics, etc.

THE CLIENT declares that hires and, where applicable, receives the project and, where applicable, the furniture and decoration elements at his own risk and venture, limiting the activity of THE HOLDER to the execution of the material tasks necessary to deliver the services selected.

15. INDEMNITY

Failure by the CLIENT to comply with these Conditions or any other that may be applicable may entail damages for the HOLDER. The client will be obliged to compensate the former for any damage, loss, or cost.

If any claim or procedure is generated against the owner due to the breaches of THE CLIENT, the latter will indemnify the owner, being able to claim the expenses, costs, or damages derived from it from the client.

16. MODIFICATIONS

NEMAI STUDIO and these conditions may be updated or modified at any time without prior notice.

These modifications will enter into force from their publication on the website.

THE CLIENT will be subject to the Terms and Conditions in force on the date on which he contracts the services of NEMAI STUDIO

NEMAI STUDIO collects personal information that THE CLIENT voluntarily provides when accessing our website for the purpose of facilitating the online interior design service. To use all the services provided by NEMAI STUDIO, the CLIENT will be required to provide the following information: Names and surnames, gender, age, email address, a telephone number associated with the mobile device, location, the specific characteristics of the space that will be decorated, floor plan, photographic material, measurements of the space, estimated budget, photos of furniture owned by the CLIENT, or adjusted to their tastes and that can be used for the decoration of their room, credit card information for the payment of the service, among other data that is relevant to the provision of the service.

The CLIENT may be asked to take a “Style Quiz” to know in greater detail what it is looking for from NEMAI STUDIO and its preferences in terms of interior design. It may include questions related to the area that will be designed, preferred colors, use of the room, and any other personal information contributing to the creation of the design.

NEMAI STUDIO is not responsible for the veracity of the information provided by the client.

NEMAI STUDIO reserves the right to use the information provided by the CLIENT to the extent that such use complies with applicable law and is for the specific purpose for which it was provided.

NEMAI STUDIO reserves the possibility of publishing on its website, as well as on different social networks, any photographic material on the design concepts developed, as well as the spaces decorated, which could include material sent by the CLIENT.

NEMAI STUDIO is not responsible for the leaking of information caused by external sources and unrelated to it, that using maneuvers violate or modify its software, gaining access to its website
